Terms and Conditions

1. Introduction
These terms and conditions (“Terms”) govern your use of Elite Waves HVAC Air-Conditioning’s products and services, including but not limited to electronic air-conditioning systems, heat pumps, maintenance contracts, and related appliances (“Products”). By using our Products, you agree to comply with and be bound by these Terms. Please read these Terms carefully before using our Products.

2. Product Purchases
2.1. All purchases of Elite Waves HVAC Air-Conditioning Products are subject to availability.
2.2. Prices quoted for Products are exclusive of applicable taxes and delivery charges, unless otherwise stated.
2.3. Payment must be made in full before the delivery or installation of Products, unless otherwise agreed upon in writing by both parties.

3. Maintenance Contracts
3.1. Elite Waves offers maintenance contracts to ensure the ongoing optimal performance of our Products.
3.2. Maintenance contracts may be purchased separately or bundled with Product purchases.
3.3. The terms and conditions of maintenance contracts are outlined in a separate agreement provided upon purchase.

4. Service Options
4.1. Elite Waves offers various service options, including purchase, full maintenance and repair rental, or bank rental.
4.2. Rental agreements are subject to separate terms and conditions provided by Elite Waves.
4.3. Clients opting for rental agreements must adhere to the terms outlined in the rental contract.

5. Client Responsibilities
5.1. Clients are responsible for providing accurate and complete information regarding their requirements and preferences to Elite Waves.
5.2. Clients must ensure that their premises are accessible for the delivery, installation, and maintenance of Products as scheduled.

6. Intellectual Property
6.1. All intellectual property rights in Elite Waves HVAC Air-Conditioning’s Products, including but not limited to trademarks, logos, and designs, are owned by Elite Waves.
6.2. Clients may not reproduce, distribute, or use Elite Waves’ intellectual property without prior written consent.

7. Limitation of Liability
7.1. Elite Waves HVAC Air-Conditioning shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or performance of our Products.
7.2. In no event shall Elite Waves’ total liability exceed the amount paid by the client for the Products or services in question.

8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

9. Amendments
Elite Waves HVAC Air-Conditioning reserves the right to amend these Terms at any time without prior notice. Any amendments shall be effective upon posting on our website or other communication channels.
